Seller: The natural or legal person offering the digital content for sale. The Seller’s identity, business name and contact details are disclosed to the Buyer before the order is placed.
Buyer: The user purchasing digital content through the platform, whose details are provided during the order process.
La Luné may act as an intermediary service provider in digital content sales between users. For services provided directly by La Luné, it may act as the service provider or seller, depending on the nature of the transaction.
ARTICLE 2 - SUBJECT OF THE AGREEMENT
This Agreement governs the parties’ rights and obligations concerning sales of digital content through La Luné.
Digital content sold under this Agreement may include images, music, videos, games, website projects, 3D models, educational materials and other digital products supported by the platform.
Sales transactions are subject to Consumer Protection Law No. 6502, the Regulation on Distance Contracts and other applicable legislation.
ARTICLE 3 - DIGITAL PRODUCT INFORMATION
The essential features, sale price, usage rights, and access and download conditions for digital content offered for sale are specified on the relevant product page.
Before completing a purchase, the Buyer must review the product description, price and any restrictions on use.
Rights to use or commercially exploit purchased digital content are limited to the scope specified in the relevant product description and any applicable license terms.
ARTICLE 4 - CONCLUSION OF THE AGREEMENT
The Agreement is concluded when the Buyer selects the digital product, reviews the order summary and pre-contractual information, accepts the obligation to pay and completes the purchase.
Once the order is completed, the purchase details are recorded in the Buyer’s account.
ARTICLE 5 - DIGITAL DELIVERY
Digital content purchased through La Luné is delivered electronically after payment has been successfully completed.
Purchased content is added to the Purchases section of the Buyer’s account on the platform.
Digital products are not shipped physically. Shipping and physical delivery procedures therefore do not apply.
If delivery fails because of technical problems, the Buyer may contact the support team.
ARTICLE 6 - DOWNLOAD AND ACCESS RIGHTS
Purchased digital content, with the exception of videos, may be downloaded in supported file formats.
Images, music, games, website projects, 3D models and other supported digital files may be downloaded after purchase.
Purchased videos may be watched only through the La Luné platform. Downloading video files is not permitted.
Downloading digital content does not mean that its intellectual property rights are transferred to the Buyer.
ARTICLE 7 - PRICE AND PAYMENT
The sale prices of digital products are displayed to the Buyer before purchase.
By completing the purchase, the Buyer agrees to pay the specified sale price.
Payments are processed through the relevant payment service provider, depending on the sales channel used.
Applicable taxes and other mandatory charges relating to the purchase are disclosed to the Buyer before payment.
ARTICLE 8 - RIGHT OF WITHDRAWAL
Under Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, consumers generally have a 14-day right of withdrawal.
However, legislation provides exceptions to the right of withdrawal for services performed immediately in an electronic environment and intangible goods delivered immediately to the consumer.
Whether these exceptions apply depends on the nature and delivery of the digital content and on whether the conditions specified in the legislation have been met.
Circumstances in which no right of withdrawal exists are clearly disclosed to the Buyer before purchase.
ARTICLE 9 - ADDITIONAL 48-HOUR REFUND GUARANTEE
For eligible digital content purchases, La Luné offers the Buyer an additional 48-hour refund guarantee from the date of purchase.
During this period, the Buyer may examine or view the purchased digital content through the platform or use its supported features.
The Buyer may request a refund within 48 hours provided that the purchased digital content has not been downloaded and the relevant conditions are met.
La Luné’s additional refund guarantee ends when the digital content is downloaded or the 48-hour period expires.
This provision does not restrict the consumer’s mandatory rights under applicable legislation.
ARTICLE 10 - REFUNDS AFTER DOWNLOADING
Before downloading purchased digital content, the Buyer is informed of how downloading affects the refund conditions.
Downloading ends the additional 48-hour refund guarantee offered by La Luné.
Whether a statutory right of withdrawal may be exercised for downloaded digital content is determined by the conditions and exceptions in the applicable legislation.
The Buyer’s statutory rights remain unaffected if the content is corrupted, incomplete or does not conform to the stated features.
ARTICLE 11 - VIDEO CONTENT
Purchased video content may be watched only through the La Luné platform.
Downloading video files is not permitted.
The additional 48-hour refund guarantee applies to video content purchases where applicable.
During this period, the Buyer may watch the video content and request a refund subject to the relevant conditions.
Statutory exceptions to the right of withdrawal and the consumer’s other legal rights remain unaffected.
ARTICLE 12 - DEFECTIVE DIGITAL CONTENT
If purchased digital content is corrupted, incomplete, unusable or inconsistent with its product description, the provisions of Law No. 6502 and other applicable legislation apply.
The Buyer may exercise the statutory remedies available for defective digital content.
La Luné may conduct support and dispute-resolution procedures relating to transactions carried out through the platform.
The Seller’s and La Luné’s responsibilities under applicable legislation remain unaffected.
ARTICLE 13 - RETURNS AND REFUNDS
The Buyer may submit a refund request through the platform’s support channels.
Applications under La Luné’s additional 48-hour refund guarantee must be submitted within the specified period.
If a refund request is approved or a refund is required by law, the relevant amount is refunded in accordance with the legislation.
Refunds are generally made using the payment method used for the purchase.
Access and download rights relating to refunded digital content may be terminated under the relevant conditions.
ARTICLE 14 - IMAGINAIRE SUBSCRIPTIONS
La Luné Imaginaire is a subscription service providing access to the platform’s advanced content-creation features.
Payments for subscriptions purchased through the Apple App Store or Google Play are processed through the relevant app store’s payment infrastructure.
Canceling a subscription stops automatic renewal.
Canceling a subscription does not mean that previous payments are automatically refunded.
Refund requests for subscriptions purchased through the App Store or Google Play are assessed through the relevant app store’s refund procedures.
La Luné does not process refunds directly for payments made through app stores.
ARTICLE 15 - CREDIT PURCHASES
La Luné may offer credit packages for use in content-creation activities.
Payments for credit packages purchased through the Apple App Store or Google Play are processed through the relevant app store’s payment system.
Purchased credits are added to the Buyer’s account after payment is completed.

La Luné does not process refunds directly for credits purchased through the App Store or Google Play.
The consumer’s mandatory rights under applicable legislation remain unaffected.
ARTICLE 16 - SELLER’S OBLIGATIONS
The Seller is responsible for ensuring that digital content offered for sale conforms to the features stated in its description.

Offering content for sale that infringes third parties’ intellectual property rights is prohibited.
The Seller’s other obligations under applicable legislation remain unaffected.

The consumer’s right to apply to legally competent authorities may not be restricted.
